其实创业，真的是九死一生，我从不劝别人创业，在我看来劝别人创业，等于“谋财害命”。创业这个东西其实比炒股都危险，大家可能不知道，法拍房的三大来源是创业、赌博、担保，创业还是排在首位的，比赌博还狠。所以，不劝人创业，就相当于积德行善了。

不投资创业，或者低成本投资，其实也能赚钱，因为目前有了很多轻资产创业模式，所有你需要的创业起步工具和素材，别人都为你准备好了，你缺的只有“坚持”了。最好的模式，一定不是忽然变化赛道，而是骑驴找马，小成本试错，找到适合自己的盈利模式，持续稳定后，再逐步扩大和模式升级。08年到现在，其实有过非常多的红利口子。像自媒体创作、短视频直播带货、百度竞价，淘宝，淘客，微商，社交电商，公众号，内容创业……

每一个领域兴起都能成就一些人，同时也能毁掉一波人。

看到这段话后对“法拍房”这个词突然感兴趣起来，随即在网上查了下。百度百科词条对“法拍房”是这样描述的，法拍房即“法院拍卖房产”，是被法院强制执行拍卖的房屋。当债务人(业主)无力履行借款合约或无法清偿债务时，而被债权人经司法程序向法院申请强制执行，将债务人名下房屋拍卖，以拍卖所得案款偿还债权。而在过程中进行拍卖的房子就是法拍房。

阿里司法拍卖的法拍房数量：2017年，9000套;2018年，2万套;2019年，50万套;2020年，133万套;2021年三季度末，159万套;2021年末，大概率突破160万套……最初，我研究法拍房是为了捡便宜。一些人为了捡到妥当的便宜，就要研究每套法拍房背后的债务关系。越研究，越心寒。每一套的法拍房背后，都是一个业主的血泪史。

今天我们就来聊聊法拍房背后的故事。

当事人“辣鸡哥”向我讲述了他的一次看房的亲亲身经历，了解这个离奇故事后唏嘘不已。他看的这间法拍房就是今天刚刚结束司法拍卖的桂花城1幢房产，这套房子产权面积近90平方米，共两人报名，11,183次围观，最后因为没人出价而流拍。几天前预约了桂花城的一套法拍房看样。本身也就是出于好奇，桂花城在当年算是豪宅盘，而且这套面积才90平。所以，打算去看了。上周五，冒着小雨，实地去了趟桂花城。本来预想很快就能看完，可结果愣是在那待了一个半小时。

之前陆续看过几套法拍房，这是第一次进还有原业主的房子!有种怪怪的味道。原业主暂时未腾退，所以自己敲了下门，门就开了。屋里面坐着一个老太太和她女儿，一进门就听到老太太在那哭，我瞬间心情就有点沉重。(女儿在里屋，我后来才看到的)老太太一家人是温州人，口音很重，我只能大概听懂，剩下一部分是靠法院的工作人员帮忙解释的。这个老太太，30多岁丈夫就去世了，一个人把一儿一女拉扯大，女儿好像是听力不行还是哪里不太好，我去里屋看房时，看她一直歪着头坐在床上。儿子结婚后，和妻子也生了一儿一女。杭州这套桂花城，是老太太的母亲和姐妹(没听明白姐姐还是妹妹)帮她买的。全家6口人住在这个89平的房子里。

这套房子，一开始是记在了老太太女儿的名下(女儿是妹妹)，后来赠给了哥哥。这个赠予是女儿亲口答应的，说愿意送给哥哥。有一次儿子(也就是业主)的朋友，貌似是高中同学，和他说自己想要一笔钱办个农家乐，但自己家的房子是老婆名下的，他老婆不愿意抵押出去。这个朋友想让他帮忙做个担保人。当时和他说的是，如果他答应这个请求，那就按照比银行高许多的利息付给他。然后老太太儿子贪小便宜了，图这个利息，就一口同意了。后来那个朋友办的农家乐倒闭了，中间不知道经过了什么流程，落到裁定书上就写了老太太儿子一个人，那个“朋友”洗得干干净净。

听这意思，估摸着就是朋友拿着钱填了银行的窟窿，把自己撇干净，债务关系就变成了老太太儿子和担保公司的了，这就是“杀熟”啊!原本老太太儿子和儿媳就有矛盾，这一下子就直接离婚了，两个小孩暂时跟着老太太儿子。老太太儿子的工作，起初是开鸭脖店，后来因为法拍的事情，跑到外面打工了，老太太也不知道打的是什么工。但目前全家6口，全靠这个儿子一个人挣钱了。

我在那里待了一个半小时，老太太从头哭到尾，讲述断断续续的，这些是我听得还算真切的内容。她说当时是借了担保公司420万，但算完利息好像要还470万，如果这个房子卖不够这个数，剩下的真不知道该怎么办。房子一旦卖了，他们举家就要去租房子，租房子更没钱，据说现在连打官司的律师费都付不起。听得很绝望，对于一个老人来讲，本来该是颐养天年的时候，却突然有这么大的变故。于是也帮她出主意，说让她收集一下物证，去报案，没钱打官司的话可以去社区请求法律援助，警察+法院，应该能帮这户人家讨个说法。如果就按照老太太说的，那应该是占理的，这属于被骗了。但现在就怕她儿子有什么事情是没告诉老太太的。这一些我就无从获知了。

之前我看法拍房时，没掺杂过一丝一毫人的情感，觉得就是个房子么。尤其是那种豪宅，不就是有钱人突然破产了么，刚刚好很多没有购房资格的人可以考虑，便宜的话还能捡漏。但对于这套房子，真心不能这么想，一家子是真的太惨了。尤其人到这个年龄，看不得孩子受苦，也看不得父母受罪。虽然这套房子我不打算参与拍卖(这房子不符合我的需求。室内本是两室两厅一厨一卫结构，但客厅改成了一个大的卧室。屋里的真实样子和法拍网上的一模一样，这个客厅阳台的外面就是文二西路)。但多个人知道这件事，或有缘人下手，或给大家做了个提醒，都是好的。

听了这个真实经历后，不少网友发表了自己的看法：网友“烟斗客”说：就住我家楼下，经常看见，没想到这么惨。唉!女儿好像身体不好的，老太太身体还好，在照顾女儿的，老太太人也挺和善的，但儿子一家没注意到。

前几天，发现一套上海的法拍房。这套法拍房的背后，只是一条简单的连带担保债务的违约，债务关系十分单纯、清晰。这是一个非常优质的法拍房，却同时也是一个幸福家庭的万劫不复!被执行人，是一个早九晚五的国企职员。寒门出门，发悬梁锥刺股，奋发图强数十载，终于在上海佣有了属于自己的一个小窝。原本的发展轨迹，应该是家庭美满，中年升迁，办公室里到退休，安享晚年，天伦之乐。直到两年前，对他有恩的老领导，拿着一份担保贷款协议，找到了他。老领导是上海本地人，离开国企以后，下海经商，顺风顺水，人脉资源都很广，小圈子里公认的老大哥。家里房产证资产有半亿，码头还有千万级别的货柜，出去一次KTV，都够自己半个月的工资。

对自己当年还有提携之情，有什么大事小事找到他从来没有推脱过，能帮则帮。 就是这样一个横看竖看都很稳的人，也犯不着坑你的人，找你帮忙—— 帮，还是不帮? 只是担保一下而已，周转一下而已，签个字而已，仅仅380万而已。 签，还是不签? 找你，那是看的起你! 结果，两年后，老大哥消失了，暴雷了。 事后才知道，老大哥的房子，分别抵押给了九家银行。码头的货柜，进了小额贷款公司名下圈内能找的找了个遍，前后贷了两个多亿 ……

天真的你以为，仅仅是380万，毕竟他家大业大，再怎么样这点钱还是还得起的，实在还不起，随便卖套房子就周转开来了。 你不知道的是，这份担保协议的背后，还有数十份的担保协议。接下来，噩梦开始了。所担保的380万，需要承担连带偿还责任。一夜之间，跌入万丈深渊。工资被冻结，房子被查封拍卖，老婆离婚。。。 区区一份担保协议，毁了一个幸福的家庭。

在很多小城市，更夸张的是“多人联保”。小城市，更要讲人情世故，圈子小，抹不开脸面，同事很多都是从小玩到大的，有的还是同学，亲戚。关系盘根深蒂固。 认识几十年都是正经人，不赌不吸不养小三，彼此知根知底。需要用钱了，往往也是确实需要周转了，扩大生产了，开场了，经商了。又不是找你一个人担保，七八个人一块担保，别人能签字，凭啥你不能签?别人都敢签，为什么你不敢签?平时称兄道弟，这会你能缩头?

在小城市，多人联保轻轻松松贷个一两百万，稍带个公职人员，三五百万也不费劲。甚至不需要房产抵押。 完事了去唱个K，喝几场酒，兄弟你们放心，生意做大了，不会亏待你们。往后年年给你们分红，连本带利一块还上，准准的。 来，满上! 不出两年，出事了! 政策突变，行情不好，遇人不淑，合伙人矛盾，竞争压力太大，总之，就是暴雷了，跑路了。签了担保协议的，连带责任，要么偿还债务，要么一块跑路，公职人员又是同样的剧本。 尤其老家的公职人员，传播的速度更快。饭碗丢了不说，更成为整个家族的耻辱。
